Towly is created by an independent developer to help you document towing incidents. We are not a law firm, legal service, insurance company, or registered business entity. This is a documentation tool only.

By using Towly, you acknowledge that you use it at your own risk and that we cannot be held responsible for any outcomes, damages, or consequences arising from your use of the app.

These Terms of Service ("Terms") govern your use of the Towly mobile application ("App"). By downloading, installing, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1. Acceptance of Terms

By accessing and using Towly, you accept and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and the App developer. If you do not agree to these Terms, you must discontinue use of the App immediately.

2. Description of Service

Towly is a mobile application designed to help users document towing incidents through:

  • Photo and video capture with timestamps and GPS coordinates
  • Incident report creation and storage
  • Community sharing of towing activity information
  • Educational resources about consumer rights

The App is intended for informational and documentation purposes only and does not constitute legal advice, legal representation, insurance services, or professional consultation of any kind.

3. Community-Driven Content and Data Accuracy

Community-Based Information: Towly operates as a community-driven platform where users share their towing experiences and observations. While we strive to maintain the accuracy and authenticity of information on our platform, we cannot guarantee that all user-generated content is completely accurate, up-to-date, or verified.

Our Commitment to Quality: We implement various measures to promote authentic and reliable information, including:

  • User reporting and flagging systems for suspicious content
  • Automated detection of potentially fraudulent reports
  • Regular review and moderation of user submissions
  • Continuous improvement of our verification processes

User Responsibility: You acknowledge that information provided by other users should be used as general guidance only. You are responsible for:

7. Intellectual Property Rights

App Ownership: The App and its original content, features, and functionality are owned by the developer and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

User Content: You retain ownership of content you create using the App. By using the App, you grant us a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, distribute, display, and perform your content solely for the purpose of operating and improving the App.

License to Use: We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

8. Privacy and Data Protection

Your privacy is important to us. Our Privacy Policy, which is incorporated into these Terms by reference, explains how we collect, use, and protect your information. Third-Party Actions: We are not responsible for the actions of towing companies, law enforcement, courts, insurance companies, or any other third parties, regardless of whether they are documented through the App.

Technical Limitations: We do not guarantee continuous, uninterrupted, or error-free operation of the App. Technical issues, server downtime, and data loss may occur.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

The App developer, and any affiliates, employees, agents, or service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits, data, use, goodwill, or other intangible losses
  • Legal fees, court costs, or litigation expenses
  • Damages resulting from towing incidents or disputes
  • Damages from unauthorized access to or alteration of your data
  • Damages from any third-party conduct or content
  • Damages from interruption or cessation of the App

Our total liability to you for all claims arising from or relating to the App shall not exceed the amount you have paid us in the past twelve months, or $100, whichever is less.

11. Indemnification

You agree to defend, indemnify, and hold harmless the App developer and any affiliates, employees, agents, or service providers from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including reasonable attorney's fees) arising from:

  • Your use or misuse of the App
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any content you submit through the App
  • Any disputes arising from your use of the App

11. International Users and Compliance

GDPR Compliance: For users in the European Economic Area, we comply with the General Data Protection Regulation. You have rights regarding your personal data as outlined in our Privacy Policy.

CCPA Compliance: For California residents, we comply with the California Consumer Privacy Act. You have specific rights regarding your personal information.

International Use: If you access the App from outside the United States, you are responsible for compliance with local laws. Your information may be transferred to and processed in the United States.

12. Termination
